CONTRACT FOR SERVICES
Unless otherwise specified, it is understood that any and all rights to all images shot and edited, thereof shall remain the property of Darya Morreale Photography and may not be used for advertising, display or any other purpose other than personal enjoyment.
If Photographer cannot perform this agreement in whole or in part due to a cause beyond the control of the parties, changing of details that no longer fit with the photographers’ originally agreed terms or due to Photographer’s illness or injury, then Darya Morreale Photography will return all fees to the client(s) but shall have no further liability with respect to this Agreement. This is the parties’ entire agreement on this matter, superseding all previous negotiations or agreements.

WAIVER AND INDEMNIFICATION
Client and it’s agent’s, family members and assignees, if any, shall indemnify, and hold harmless Darya Morreale Photography and Darya Morreale from any and all claims for damages arising out of the performance of any of the services contemplated by this Agreement with the exception of intentional or illegal acts.


DAY OF THE SESSION
You agree that you will be dressed in your first outfit, and arrive on time to the chosen location. If you are late, time will be taken from your session or charged under “Extra Time” herein, at the sole discretion of Darya Morreale Photography. Friends and family are welcome, so long as they do not interfere with the photographer and the photography taking place. Pictures with friends or family are not permitted unless it has been discussed previously with the approval of the photographer.

PAYMENT AND PACKAGES
Payment will be required on the day of shooting. Cash, personal checks, PayPal and all major credit cards are accepted forms of payment. For checks, no retouching or work will be done until funds have been cleared. Returned checks are subject to a $35 charge. You may not downsize to a smaller package after you have paid the deposit for that package. However, you may upgrade to a larger package at any time, though it exclude any of the outfit changes. Separate charges will apply for the specified package.

The Client shall reimburse Photographer for any additional costs the Photographer may incur for parking, park entry fees and other reasonable costs necessary to the performance of these services.

RECEIVING RETOUCHED PHOTOS
Please allow up to 30 days from the date of your session to receive your digital photos. Times will vary on season and other factors.

RETOUCHING TIME AND PROCESS / ONLINE GALLERY
Darya Morreale Photography will select best images from photography session, and begin editing and retouching as soon as next day after your session.
Please allow a maximum of 4 weeks from day of your session for your final 20 images to be finished and uploaded to your gallery.
(3 weeks for 10 images & 10 days for 3-5 images)
 Your gallery will be created and link will be emailed to you as soon as 1-3 images are edited and uploaded to the gallery. You may start downloading, printing and sharing your images as soon as they appear in your gallery. Your gallery will have two folders titled PRINT and WEB. All images in PRINT folder are high resolution and intended for printing purposes only. All images in WEB folder are resized and watermarked and intended for social network and email sharing.


EXTRA TIME
Any additional time spent due to the lateness of the client, retouching, or editing, that are not otherwise paid for under this Contract shall be charged at the rate of $75 per hour. Darya Morreale Photography may elect to perform these services or refuse them, at its sole discretion. Client agrees to pay these services as invoiced, and may be required to pay for these services ahead of their provision.

COLORING AND RETOUCHING
Basic retouching includes clearing skin, getting rid of flyways and single strands of hair in the face and obvious blemishes. Basic retouching does not include things like physically changing body shapes, fixing dresses, removing people or things from a photo, fixing clothes/makeup/etc. or adding things to photos. The client may choose to pay per hour for extra retouching.

COLORS AND STYLES
By choosing Darya Morreale Photography you acknowledge the style and colors used and agree to allow the photographer full creative control over editing colors and styles based on personal preference .

UNEDITED PHOTOS/PHOTO POLICY
No RAW (NEF) files will ever be given to the client under any circumstances. Only your retouched photos will be released. If you would like to purchase additional photos, you must buy each pose separate from your package.
All outtakes and unedited photos are the property of Darya Morreale Photography and are not to be shared, distributed or posted under any circumstances.

OVERALL APPEARANCE AND PERSONAL ITEMS
The photographer is not responsible for any missing, damaged or altered clothing/material belonging to the client. Please be aware that for some photos you may or may not get dirty. It is ultimately your responsibility to make sure your clothes, makeup, hair and overall appearance are the way you want for the photos. The photographer is not responsible for any styling, makeup issues, hair problems or any other factors in the photography other than the directing and photography of the client.

WEATHER AND SESSION CHANGES/LOCATIONS
You are able to switch your day because of weather or personal reasons, so long as no other sessions are scheduled that day and it works for the photographer. Locations within 15 minutes of Las Vegas are free. Any other location outside 15 minutes of Las Vegas is subject to a separate charge based on distance. Cost of location permits for shooting or availability and the choosing of a location is the responsibility of the client. Unless otherwise stated, all photo sessions come with ONE location in Las Vegas. Add-on locations are additional cost.

CLIENT’S COOPERATION
Deliverable items and shots are contingent upon the client performing actions and cooperating with the photographer. The photographer is not liable if the client’s neglect leads to a compromise of what has been agreed upon. (i.e. agreeing to take photos of a bride getting ready, but she does not make herself available for the time). The Photographer shall not be responsible for photographs not taken as a result of the Client’s failure to provide reasonable assistance or cooperation.

DIGITAL FILES AND CDs
CDs are not available through Darya Morreale Photography. All files will ordinarily be sent digitally through a link to an online gallery or email and will be made available for download. Any edited photos ordered are non-refundable, whether or not client decides to keep them.

REFUNDS
Client agrees that no refunds will be issued after photography services performed and photos delivered to the client . If you choose to re-do your photos for any reason, it will be considered as a new session and you will need to purchase a new package. The reatainer fee is non- refundable. In the event of an emergency, equipment failure or other unforeseen circumstance, the photographer will return any money given up to that point. but claims no further liability.

CLIENT’S USAGE
The Client is obtaining images for personal use only, and shall not sell said images. It is not permitted to give photos to vendors having their products or setups photographed in order to use for advertising or promotion. No commercial use is granted by the issuance of print or digital photos.

DIGITAL NEGATIVES, PRINTS & COPYRIGHT
All images and copyrights are the property of Darya Morreale Photography ("Photographer"). In exchange for services provided, Photographer retains the exclusive right to copy, edit and distribute any/all images created under this agreement, to the general public, for any reason, including but not limited to: advertising,marketing, sales, print competitions, educational seminars, and monetary gain. The mediums for display could include newspapers, magazines, books, television, and the internet, but are not limited to only those mediums. The Photographer retains these rights even if image files are turned over to the Client.

All photos created by Photographer are copyright protected. It is a violation of federal copyright law to copy, scan, or allow photographs created by Photographer to be reprinted, duplicated, digitally reproduced, copied, scanned, or altered digitally or otherwise, without Photographer's express written permission. The negatives/digital files remain sole property of Photographer and will never be given or sold.

Photographer agrees to grant these image rights to the client with a non-exclusive, limited, perpetual license.

This license allows the client to do the following with the images:

1) Display the images;

2) Print the images;

3) Upload, email, or electronically transfer the images or files; and,

4) Publish the images on personal websites or social media websites

THIS LICENSE WILL PROHIBIT THE CLIENT FROM DOING THE FOLLOWING:

APPLYING FOR COPYRIGHT REGISTRATION OR SELLING OF ANY IMAGE OR ELECTRONIC FILES SUPPLIED BY PHOTOGRAPHER

MAKING ‘DERIVATIVE WORKS’ OR OTHERWISE MODIFY, INCLUDING EDITING AND/OR MANIPULATING ELECTRONIC FILES
Violators of this Federal law will be subject to civil and criminal penalties.

MODEL RELEASE
Client grants to Photographer and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of Client, Client’s child or children, or in which Client may be included for editorial, trade, advertising and other purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. Client hereby releases Photographer and her legal representatives and assigns from all claims and liability relating to said photographs.

EXHIBITION
Client grants Photographer permission to display selected images resulting from this assignment as an example of Photographer’s work and for entrance into photographic competitions and releases all claims to profits that may arise from use of images.

EXCLUSIVITY
It is understood and agreed that no other photographer will be allowed to photograph or take pictures while the Photographer is working. The Photographer shall be the exclusive photographer retained by the Client for the purpose of photographing the event/session. Guests, Family and friends of the Client shall be permitted to photograph using mobile phones only as long as they shall not interfere with the Photographer’s duties.

Please Note: Due to health and allergy reasons you will be responsible to bring your own cake for your child's cake smash session.

DELIVERABLES: Images provided by Photographer shall be of a style and quality generally similar to photographs visible on Photographer’s portfolio website at www.DaryaMorrealePhotography.com Clients agree that Photographer is hired for his creative interpretation, and may deliver artistic images including ones that have areas of selective focus, or in black-and-white, with creative framing or cropping, or with other effects. While allowing for artistic interpretation, an image shall be considered “usable” if it generally meets the following criteria: 1) The primary subject of the photograph is in focus, 2) The exposure of the photograph is such that there is a range of believable tones from dark to light, 3) The color of skin tones is believable to a reasonable person.

RELEASE:
On behalf of all attendees of the wedding, Clients hereby grant the following rights and permissions to Photographer, his legal representatives and assigns, those for whom Photographer is acting, and those acting with his authority and permission. Photographer has the absolute right and permission to take, use, reuse, publish, and republish photographic portraits or pictures of those photographed, including any minors, or in which any minor may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations from time to time, in conjunction with the adult’s or minor’s own or a fictitious name, or reproductions of such photographs in color or otherwise, made through any medium at Photographer’s studios or elsewhere, and in any and all media now or hereafter known, including the Internet, for art, advertising, trade, or any other purpose whatsoever. Clients also consent to the use of any published matter in conjunction with such photographs. Clients specifically consent to the digital compositing or distortion of the portraits or pictures, including without restriction any changes or alterations as to color, size, shape, perspective, context, foreground or background. Clients waive any rights they may have to inspect or approve any finished product or products or the advertising copy or printed matter that may be used in connection with such photographs or the uses to which it may be applied. Clients understand that the images of those photographed, including any minors, may be used in print or on the Internet. Clients nevertheless consent to this use. Clients release, discharge, and agree to hold harmless and defend Photographer, his legal representatives or assigns, and all persons acting under his permission or authority or those for whom he is acting, from any liability by virtue of any reason in connection with the making and use of such photographs, including blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication of them, including without limitation any claims for libel or violation of any right of publicity or privacy. Clients hereby warrant that they are legal and competent adults and have legal authority to make such an agreement on behalf of any minor present at the wedding. Clients state further that they have read the above authorization, release, and agreement, prior to its execution, and that they are fully familiar with the contents of it. This release shall be binding upon the Clients, and Client’s respective heirs, legal representatives, and assigns.

By booking a session with Darya Morreale Photography you have read and agreed to the above policy.



>>>>> WHAT TO WEAR <<<<<

Once your session is booked, this is the first and most important question I am asked.  What to wear. Aside from the communication between your family members during the session, this is the most important aspect of the pictures that you can control. I will take care of the rest (good location, lighting, posing and etc.). I’ve given you this style guide as a little behind the scenes look into how to style your family session. I enjoy helping my clients to pick up clothes especially given that some outfits look great in real life and bad on camera (and vice versa) and it could be challenging for my clients to choose. So, if you are debating between outfits – please feel free to share with me by snapping a picture and sending it over.

My best advice – dress up! You are going to have these photos for the rest of your life, most of my clients order huge prints from their family session to decorate their walls. Think about those pictures as future art pieces for your home.

Long dresses look great especially in outdoor setting I am shooting in.

My photography focuses on light so wearing colors that reflect well off the sun are highly recommended. This means neutral tones, light or airy colors. Examples are blush, gold, yellow, white, pastel, etc. Black is terrible in light and doesn’t look great on pictures – so please don’t wear black. This is mostly relevant to girls; guys could wear a black suit or pans.

Very important moment – your dress doesn’t have to be expensive, good quality or even well fitted! It will look great on camera as long as it’s in the right color and has a style.

A few things NOT to do…
*Please avoid anything with logos, graphics, sports teams, characters, labels, etc. These tend to take the “finished” look of a professional portrait down a few notches, can be distracting and will date a photo quickly.
* Don’t have everyone wear all the same color – matching is boring and dated. Please do complimentary colors instead of matchy-matchy.  
* No black or dark clothes. Family shoot in such tones just doesn’t fit my style and the type of settings I am shooting in. Also, light pastel colors look sophisticated compared to bright colors for those types of sessions.
* No casual clothes and no sneakers, please. This can detract from the finished and timeless look of your portrait.

Wardrobe is an ESSENTIAL piece of the puzzle as we work together to create your portrait art. I encourage all my clients to feel free to text me (sometimes right from the store!) if they want my opinion on an item of clothing. Choosing the right outfits can really make or break the session.
